Divorce - the procedure
After purchasing one of our packages you will be able to complete the relevant questionnaire. All our forms are simple and easy to follow. You can return the completed form to us at the click of a button, but you will need to send your marriage certificate and the first of two cheques for the Court fees to us by post. The Court charges a fee for processing a divorce. At present it is £300 when you file your Petition and £40 when you apply for your Decree Absolute. These are standard charges throughout the country.
If you do not have your marriage certificate, we can obtain a copy on your behalf.
We will then immediately proceed to draft your Divorce Petition. As solicitors we can sign the Petition on your behalf thereby putting ourselves “on the record”. This ensures that all future correspondence from the Court is sent to our offices direct and not via your own personal address. We send the Petition together with your Marriage Certificate to the Court.
The Court sends your Divorce Petition and an Acknowledgement of Service to your spouse.
Your spouse returns the completed Acknowledgement to the Court indicating his or her consent to the divorce.
The Court returns a copy of the signed Acknowledgement to us and we ask you to fill in a further short questionnaire, the answers to which enable us to prepare an Affidavit or Sworn Statement with a Request for Directions, in effect asking the Court to grant you a Decree Nisi.
We will send you a copy of the Affidavit and you need to swear to it in front of a local solicitor or at your local Court. You then return the sworn form to us using our FREEPOST service.
On your behalf, we file the Affidavit and Request for Directions and the Court grants a date for the pronouncement of your Decree Nisi.

The Decree Nisi is pronounced at Court. There is no need for you to attend, although you can if you want to.
Six weeks and a day after the pronouncement of your Decree Nisi you can apply for your Decree Absolute. This is done by us filing a simple application with the Court along with your payment of £40, as mentioned above, to issue this final decree.
Your Decree Absolute is granted. The divorce has taken place.
